School Bus Hits Teen in Loxahatchee

October 28, 2010 – Loxahatchee, FL ― Ryan Garcia was hospitalized at St. Mary’s Medical Center on October 27 after a school bus hit him in the vicinity of Seminole Ridge High.

According to reports on CBS12.com, the bus driver, Johnny Burroughs Sr., was reassigned to non-driving duties as authorities investigate the cause of the pedestrian accident. Charges against the school bus driver might be pending.

The accident occurred north of Sycamore Drive at Seminole Pratt Whitney Road. According to police, 17-year-old Garcia was crossing the street on Seminole Pratt Whitney when he was struck by the bus. Thankfully, the school bus was not occupied with students at the time of the crash.

Police said the bus was stopped at a red light, and when the light turned green, the bus turned left to enter Seminole Pratt Whitney while Garcia was in the crosswalk. Burroughs told police he did not see the teen, who was wearing dark clothing on that foggy morning.

It was initially thought that Garcia’s injuries, including head trauma, were life-threatening, but he was later reported to be in stable condition.

Burroughs, employed as a bus driver since 1991, had been cited numerous times for speeding and other traffic offenses. The last time he received a citation was in January of this year.

According to the 2009 Florida Department of Highway Safety and Motor Vehicles Traffic Crash Statistics Report, there were 197,214 traffic crashes resulting in injury and 2,563 fatalities as a result of vehicle accidents in Florida.

Partial Fault Means Partial Damages

Every state has a law for how to handle personal injury cases such as car accidents in the event that both parties involved are found to have caused the accident through negligence. Florida operates with a pure comparative fault law, which allows a victim to be up to 99% at fault for their own injury and still recover 1% of the damages awarded in their claim.

The degree of fault is determined after reviewing the evidence and circumstances involved in your South Florida car accident claim. The presentation of this evidence is critical, and your best option is to hire a Palm Beach car accident lawyer to help you persuade the court that the other driver was primarily responsible for your accident.

Once the percentage of fault is determined, the trial proceeds to settlement, placing a final dollar value on your case. The lower your degree of fault, the more of this settlement you are entitled to collect. For example, a South Florida car accident claim that settles for $100,000 would give a plaintiff who was found to have a degree of fault of 20% a final settlement of $80,000.

There’s more information on how your South Florida car accident is affected when you are partially at fault in our article library. Knowing how to best prove a low degree of fault is important to your settlement amount, and a trusted Palm Beach car accident lawyer from 24/7 Injury Law can help. Dangers for Motorcyclists

According to the National Highway Traffic Safety Administration (NHTSA), drivers are at fault in two-thirds of accidents that involve a motorcycle and a car.

Situations that usually lead to such accidents include:

  • a car that turns left in the motorcyclist’s path;
  • a motorist who fails to check their blind spot before switching lanes;
  • hazardous conditions such as debris, which may force the motorcyclist to take action that the driver did not anticipate; and
  • visual obstructions.

Accidents can cause serious injury to a motorcyclist, even when a helmet is worn.

Injuries common among motorcyclists include:

  • cerebral hematoma, which is bleeding from the brain;
  • lung damage or fractured ribs;
  • neck and spinal cord trauma;
  • spleen and liver damage;
  • broken arms and legs, as well as a fractured pelvis; and
  • abrasions (from scraping the pavement).

Medical treatment after a motorcycle accident is costly, especially for injuries that involve the spinal cord and head. A Palm Beach motorcycle attorney can help by gathering and analyzing the necessary evidence to hold the negligent parties liable in your South Florida motorcycle accident.

Premises Liability in Florida Extends Beyond Slip and Fall

A slip and fall accident in Florida falls under the category of premises liability, which encompasses many accidents besides your standard slip and fall on a wet surface.

Other accidents involving premises liability include:

  • collapsing to the floor after sitting in an unsteady chair;
  • tumbling down a rickety staircase;
  • tripping after stumbling over a pothole; and
  • being attacked because of negligent security.

In all premises liability cases, evidence needs to be collected quickly. Otherwise, the party responsible for your accident could make any necessary repairs to cover up the conditions that led to your injuries.

Your Palm Beach personal injury lawyer will have to move fast to investigate your case and show that negligence was indeed a factor that led to your personal injuries. This can be accomplished through photographs, witness testimony and maybe an expert witness.

You can help by preserving evidence such as your shoes or clothing, which may contain residue of any substance that caused you to fall. You should also take photographs of your injuries immediately after the accident.

The sooner after your slip and fall accident that you contact a Palm Beach personal injury lawyer, the sooner action can be taken to preserve evidence.

Florida premises liability law, like all personal injury torts, are subject to change and your Palm Beach personal injury lawyer is your best resource for the most up-to-date information about the laws that will apply to your particular case.

Drunken Driver May Have Caused Accident that Killed 11-Year-Old

October 14, 2010, Loxahatchee — Police authorities suspect a drunk driver may be at fault for the fatal car accident that killed a girl near Loxahatchee on October, 10, 2010.

According to reports from CBS12.com, 10-year-old Khonni Louis died when her mother collided with a Ford F-250. The pickup truck was idle and facing west on Northlake Boulevard in the vicinity of 140th Avenue, officials said

The Palm Beach Post reports that a van carrying a group of day laborers from Fort Pierce to West Palm Beach crashed on I-95 near the exit for Indiantown Road around 6:35 a.m. Jose Aguiniga Gil was pronounced dead at the scene.  The 38-year-old was not wearing a seatbelt.

Uninsured Motorist Coverage can be Stacked in Florida

In Florida, your uninsured/underinsured motorist coverage can be stacked, meaning the limits can be multiplied according to the vehicles you have on your policy. Suppose your uninsured/underinsured motorist coverage is $100,000. If 3 cars are on your policy when an accident occurs, your uninsured/underinsured motorist coverage would be limited to $300,000.

Uninsured/underinsured motorist coverage is almost a necessity in Florida, where 23% of drivers have no car insurance.

Uninsured/underinsured motorist coverage, depending on the limits you purchase, could cover:

  • Medical bills – 100%.
  • Lost wages – 100%.
  • Pain and suffering – 100%.

Your uninsured motorist coverage can help protect you as well as any passengers in your vehicle if a negligent driver with no insurance causes a serious accident. You would also be covered as a passenger in another vehicle, as a pedestrian or as the victim of a hit and run accident. Although uninsured/underinsured coverage is not terribly expensive, the benefits are valuable. (Insert link to Uninsured/Underinsured Motorist Coverage)

Without it, you could be at a loss. Even if you have health insurance, be mindful that it might not fully cover damages from a serious car accident in Florida. In addition, health insurance cannot cover lost wages and pain and suffering, as uninsured/underinsured motorist coverage can.
