Lake Worth Road Targeted for Safety Crackdown

July 16, 2010 – Lake Worth, FL – Lake Worth Road, a popular route for many area residents, is the target of Palm Beach County Sheriff’s deputies who have dubbed it a “corridor of death.”

WPBF25 reports that the recent rise in safety awareness programs stems from the 50 crashes reported along the road from August 2008 to January 2009. Sgt. Talal Masri mentioned the “corridor of death” nickname when asked how the investigation came about.

After the unusually high number of pedestrian and bicyclist accidents along Lake Worth Road, deputies began analyzing the incidents. Most of the victims were Hispanic males between the ages of 17 and 45, most under the influence of alcohol at the time of the accident.

Driver and pedestrian awareness are the strongest tactics to fight pedestrian traffic injuries. Deputies spent Thursday afternoon handing out educational fliers to local business owners, hoping that local bars and restaurants will take better care to help intoxicated patrons reach home safely.

Drivers are asked to be extra cautious when traveling near pedestrians and cyclists as well. Awareness by both driver and pedestrian is necessary for a safe roadway program to be effective.

According to the National Highway Traffic Safety Administration’s 2008 Florida Crash Statistics, there were 2,978 fatalities as a result of car accidents in Florida.

Proving Breach of Duty in a Personal Injury Claim

The foundation of your personal claim is built on proving that a relationship existed between you and the defendant where they owed you a duty of care. There are some clear-cut relationships that fall into this category such as:

  • Guest and party host;
  • Patient and doctor;
  • Customer and store owner;
  • Homeowner and repairman; and
  • Child and daycare worker.

The former party in these relationships would be the plaintiff who establishes a degree of trust in the latter party, the defendant, to provide them a service or environment free of hazards. The latter party by nature owes all their guests or customers a degree of duty that their services or facility will not harm them.

To prove a breach of duty occurred you the plaintiff should be able to identify that a relationship such as described above existed between yourself and the defendant. You must also be able to show that the actions or inactions of the defendant were responsible for your injuries. In other words, the accident would not have occurred had the defendant’s breach of duty to you not occurred.

The elements of a negligence case in a personal injury claim can be difficult if you do not understand breach of duty, cause in fact, and other elements that are considered during a personal injury case. Fatal Bicycle Accident Now Ruled Homicide after Investigation

July 10, 2010 – Homestead, FL – What originally seemed like a hit and run accident that killed a bicyclist is now being ruled a homicide after further police investigation.

CBS4 reports that the fatal hit-and-run accident that left 31-year-old Daniel Martinez dead on the scene was the result of an earlier argument at a convenience store.

Martinez was at the store where witnesses say someone tried to rob his brother, Abel, and started an argument. Martinez got on his bicycle and went after the robber, but was struck by a white car which seemed to veer off to intentionally hit him.

The car left the scene but was later located. Paramedics arrived on the scene but were unable to revive Martinez.

Family members say there had been issues between Martinez and the others involved in the argument at the convenience store. Miami-Dade Police investigated those involved and arrested 31-year-old Jorge Lugo on Sunday, charging him with first degree murder and aggravated assault with a deadly weapon.
