Understanding the Basic Premise of a Florida Personal Injury Claim

The basic premise of any personal injury claim is negligence. In order to prove that a defendant (the person or entity you are seeking damages from) was negligent and responsible for your accident, your attorney must first establish that a duty of care existed between you and the defendant, and that the defendant breached that duty of care and directly caused your accident injuries.

This negligence can be proven in a Florida personal injury claim by showing that the defendant failed to give the injured party – the plaintiff – a reasonable amount of carefulness. This is the basic premise of all injury claims whether you were involved in a car accident, slip and fall injury, truck accident, worksite accident, and so on.

Once you’ve established a relationship involving duty of care, the rest of your injury claim will depend on how successfully your Palm Beach injury attorney can argue that the defendant breached that duty of care through their actions or inactions. Florida works under a modified comparative negligence rule, which means the other party must be found at least 51% responsible for your accident in order to you to be eligible to recover any compensation at all.

This is why it is so important to work with an experienced Palm Beach injury attorney who has handled Florida injury claims similar to your own and understands (and fully explains to you) any and all challenges involved in your case when proving negligence.

Preparing to File a Florida Personal Injury Claim

The basis of almost every Florida personal injury claim is that the negligence of the other party caused your injuries. By proving that you were not completely at fault for your injuries, you are usually able to successfully file a Florida personal injury claim and recover compensation for your damages

Proving you were not at fault is known as the “degree of fault” and is a percentile number that an insurance adjuster or jury determines based on your evidence. To have the most success in your Florida personal injury claim you need to collect as much evidence as you can regarding your accident and injuries. Some of the most helpful evidence you should obtain include:

  • photographs of the accident site and your injuries;
  • witness statements about the accident;
  • doctors’ statements about the extent of your injuries and future treatment needs;
  • medical records and bills;
  • police reports; and
  • personal notes about your physical recovery.

Collecting this evidence and organizing it can be a daunting task, especially if you are still recovering from your injuries. A Palm Beach injury lawyer can help you track down all your records, obtain witness statements, and prepare everything as if you were going to trial, even if you manage to settle out of court.

Our article library has more information on filing a Florida personal injury claim, including how the degree of fault may affect your claim.
